Welcome to Big Bear Hiking Adventures (“BBHA,” “we,” “us,” or “our”).
These Terms and Conditions govern your use of the Big Bear Hiking Adventures website and your purchase or participation in guided hikes, special events, and other experiences offered by BBHA.
By using this website or booking an experience with BBHA, you agree to these Terms and Conditions.
Using Our Website
You may use the BBHA website for lawful purposes and in accordance with these Terms and Conditions.
You agree not to:
- Use the website for unlawful or fraudulent purposes
- Attempt to interfere with the operation or security of the website
- Access areas or information that you are not authorized to access
- Copy, reproduce, or use BBHA website content for commercial purposes without permission
- Submit false, misleading, or fraudulent information
We reserve the right to restrict or terminate access to the website when necessary to protect the website, our business, our customers, or others.
Booking an Experience
When you book a BBHA experience, you agree to provide accurate and complete information.
A booking is not considered confirmed until the booking process has been completed and confirmation has been provided by BBHA or through our booking system.
The person making a booking is responsible for providing accurate information for all participants included in the reservation.
BBHA may contact you using the information provided during booking regarding your reservation, including confirmations, reminders, schedule changes, weather conditions, trail conditions, meeting instructions, and other information necessary for your experience.
Payment
Payment is required according to the price and payment terms displayed at the time of booking.
Prices may change for future bookings, but the price displayed and accepted at the time of your completed booking will apply to that reservation unless otherwise stated.
Payments made through the website are processed by third-party payment providers. BBHA does not intentionally store complete payment card information on its website.
Cancellations, Refunds, and Transfers
BBHA’s cancellation, refund, and booking-transfer policies are provided in the Cancellation and Refunds section of the FAQ page on our website and may also be presented during the booking process.
By completing a booking, you acknowledge that you have reviewed and agreed to the cancellation and refund terms that apply to that booking.
Because guided outdoor experiences involve weather, trail conditions, permits, guide availability, and other factors beyond our control, BBHA may need to modify, postpone, reschedule, or cancel an experience when circumstances require it.
Weather and Trail Conditions
Outdoor conditions can change quickly.
BBHA may modify a route, meeting location, start time, duration, or other aspect of an experience when reasonably necessary because of weather, trail conditions, road conditions, closures, wildfire activity, safety concerns, permit requirements, or other circumstances.
BBHA will make reasonable efforts to communicate significant changes to participants.
Safety decisions made by BBHA are final.
Participant Responsibilities
Participants are responsible for:
- Providing accurate information during booking
- Arriving at the designated meeting location on time
- Following reasonable instructions provided by the guide
- Bringing appropriate clothing, footwear, water, food, medications, and other personal items appropriate for the activity
- Informing the guide of relevant limitations or concerns that may affect participation
- Behaving respectfully toward the guide, other participants, the environment, and other trail users
Participants are expected to honestly assess whether a particular hike or activity is appropriate for their abilities and circumstances.
BBHA may decline participation or end a participant’s participation when the guide reasonably believes that continuing would create a safety concern for the participant, guide, or others.
Assumption of Risk and Waiver
Guided hiking and other outdoor activities involve inherent risks, including but not limited to uneven or slippery terrain, rocks, roots, steep or narrow trails, falls, changing weather, heat, cold, wildlife, insects, altitude, physical exertion, falling objects, road or trail hazards, and other risks associated with outdoor recreation.
Participants must complete BBHA’s required participant waiver before participating in an applicable experience.
The participant waiver is a separate agreement and governs the participant’s acknowledgment and assumption of the risks described in that document.
These Terms and Conditions do not replace the required participant waiver.
Dogs and Other Animals
Dogs and other animals are permitted only on experiences where BBHA specifically allows them.
Participants are responsible for following any animal-related requirements communicated by BBHA and for ensuring that their animals do not create a safety or access issue for the guide, other participants, wildlife, or other trail users.
Specific experiences may have additional restrictions.
Intellectual Property
Unless otherwise stated, the content of the BBHA website, including text, photographs, graphics, logos, branding, and other original materials, is owned by or used with permission by Big Bear Hiking Adventures.
You may view and use the website for your personal, non-commercial purposes.
You may not reproduce, modify, distribute, publish, sell, or commercially use BBHA website content without prior written permission.
Third-Party Services and Links
BBHA uses third-party services to support website functionality, booking, payments, waivers, communications, and other business operations.
The website may also contain links to third-party websites.
BBHA is not responsible for the content, availability, security, privacy practices, or terms of third-party websites or services.
Your use of a third-party service may be subject to that provider’s separate terms and policies.
Website Availability and Accuracy
We make reasonable efforts to keep the information on our website accurate and current. However, information may occasionally change or contain errors.
Trail conditions, weather, availability, pricing, schedules, events, and other information may change without notice.
BBHA does not guarantee that the website will always be available, uninterrupted, error-free, or completely current.
Limitation of Liability
To the fullest extent permitted by applicable law, BBHA is not responsible for losses, damages, or expenses arising from your use of the website or participation in an experience except to the extent such liability cannot legally be excluded or limited.
Nothing in these Terms and Conditions is intended to waive or limit rights or protections that cannot legally be waived or limited under applicable law.
The participant waiver provided for a particular experience may contain additional terms regarding assumption of risk, releases, and limitations of liability.
Changes to These Terms
BBHA may update these Terms and Conditions from time to time.
When changes are made, the “Last Updated” date at the top of this page will be updated.
Your continued use of the website after changes are posted constitutes acceptance of the updated Terms and Conditions.
For bookings already completed before a change, the terms applicable at the time of booking will generally continue to govern that booking unless otherwise required by law or agreed between BBHA and the participant.
Governing Law
These Terms and Conditions are governed by the laws of the State of California. That is without regard to its conflict-of-law principles, except where applicable law requires otherwise.
